(i) Your public wallet address
(ii) Your name, email address, phone number, and other similar details
(iii) Arising from your interactions with us (e.g., customer care queries or complaints), we will hold details of those interactions (e.g., email correspondence)
(iv) Account information, account numbers, account status, transaction history, transaction and payment details, bank account details, virtual asset details, other financial data
(v) Communication Data and Contact Data as well as any direct marketing preferences expressed by you
(vi) Statistic and Usage Information on usage of our website(s) and apps, including information generated to fix bugs and technical errors

2. Legal bases

The personal data described above is used by us and by third party service providers acting on our behalf. The legal bases on which we collect, process and transfer your personal data for these purposes are:

(i) Your consent (“Consent”).
(ii) Where such processing is necessary for the performance of your contract with us (“Contract”).
(iii) Where such processing is necessary to comply with our legal and regulatory obligations (“Legal Obligation”).
(iv) Where such processing is necessary for our legitimate interests (“Legitimate Interests”).

Where we have listed legitimate interests as a legal basis for processing, we will not process your personal data for these purposes if our or the third party’s legitimate interests should be overridden by your own interests or fundamental rights and freedoms.

The personal data relating to you that we hold is generally collected directly from you (e.g. when you make an application for a wallet account).

We may disclose any of your personal data detailed in section 1 above to third party recipients in connection with the above purposes, including:

(i) To third parties who we engage to provide services or benefits to us or to you, such as professional advisers, auditors, insurers, and outsourced IT and other service providers, including those that we use to verify your information against sanctions or denied party lists through a database.

(ii) To competent government, regulatory and law enforcement authorities and other similar bodies as requested or required by law.

5. Retention

Pretium retains your personal information as long as necessary to offer our services to you. The retention period may vary depending on the data type, the country where we collected the data, the user category, the purposes for which we collected the data, and whether the data must be retained after an account deletion request as may be applicable.

6. Necessity of provision of certain information and consequences

There are certain pieces of information that are required so that we can comply with legal obligations that apply to us (e.g. you must provide us with Identification Data in order that we can conduct KYC, CTF and AML checks prior). If we do not receive this information, this will impact our ability to deal with you in compliance with our obligations and internal policies.

7. Cross-border transfers of personal data

To the extent that we transfer your Personal Data outside the country of its collection, we will ensure that such transfers are conducted lawfully and that recipients of the data in third countries are required to comply with the applicable data protection laws governing the transfer.

If we transfer your Personal Data to a third party in a foreign country with data protection laws that may differ from those in the country of collection—whether for cloud storage, identity verification, fraud prevention, or other legitimate purposes—we will rely on applicable standard contractual clauses and implement commercially reasonable security measures to safeguard the data being transferred.

To protect your personal information, Pretium Finance employs commercially reasonable measures, including but not limited to firewalls, password-secured databases with restricted physical and electronic access, and encryption. Moreover, Pretium finance may employ secure technologies like SSL to securely transmit user-provided information, along with additional measures during the handling of sensitive data. Despite our dedicated efforts to shield your personal information, we are unable to guarantee that accidental circumstances or unauthorized actions of third parties might not lead to the inadvertent exposure or access of your information.

10. Information sharing

Pretium may share the information we collect from you with third parties to facilitate the delivery of services, prevent and investigate fraud, or address other criminal activities. These third parties are contractually obligated to protect your data in line with our Privacy Policy. The categories of recipients include:

(i) Fraud Prevention and Identity Verification Service Providers: We may share your information with third-party providers to prevent fraud and verify the accuracy of the information you provide against public records. These service providers may retain and use your information solely for identity verification and fraud prevention services, as well as to enhance their own services related to these purposes.

(ii) Operational Service Providers: This includes providers supporting financial, legal, and technical audits, legal services, marketing, payment processing, and other services. These providers may assist in analyzing and improving the Pretium Finance site and Service experience.

(iii) Marketing Service Providers: With your consent, we may share your information with marketing service providers. You may withdraw your consent at any time, after which you will no longer receive marketing messages from us.

(iv) Advertising Agencies: Third-party advertising agencies may display ads when you use our app. These agencies may utilize information from your app visits and web cookies to deliver advertisements for products or services that may interest you.

(v) Legal and Government Authorities: We may disclose your information to local or foreign law enforcement, government officials, or other third parties when required by law, subpoena, court order, or similar legal process. Disclosure may also occur in good faith when necessary to prevent harm, financial loss, investigate potential illegal activity, or address violations of our Terms and Conditions.

(vi) Business Transfers: In the event of a merger, acquisition, or sale of Pretium’s assets, your information may be transferred to the new entity. The new entity will be required to adhere to this Privacy Policy, and we will notify you of any changes to the applicable policy.

(vii) Affiliates and Subsidiaries: Your information may be shared with Pretium’s subsidiaries, affiliates, or other controlled entities.

(viii) Investors: We may share aggregated or general business-related information with our investors strictly for business analysis purposes.

(ix) Other Third Parties: We will only share your information with other third parties when you provide explicit consent or direction, unless legally permitted to do so without your consent.

Within Pretium, access to your information is limited to employees who require it for compliance, customer support, and verification purposes. Your data will only be shared with third-party affiliates when necessary and in direct relation to your transactions.

Pretium will never sell or rent your personal information to third parties.

11. Indemnity

By agreeing to the terms of this Privacy Policy, you release Pretium Finance, its promoters, officers, directors, employees, affiliates, agents, subcontractors, and representatives from any claims, demands, liabilities, lawsuits, penalties, costs, or expenses (including attorneys’ fees) that may arise from:

(i) The sharing of information with third parties in accordance with this Privacy Policy;
(ii) Any breach of obligations, terms, representations, warranties, or commitments outlined in this Policy;
(iii) Violations of confidentiality requirements under this Policy.

This indemnity will remain in effect even after your relationship with Pretium has ended, regardless of the reason for its termination.

Additionally, Pretium shall not, under any circumstances and regardless of the nature of the claim, be liable for indirect, special, punitive, exemplary, speculative, or consequential damages. This includes, but is not limited to, loss of use, data, business interruptions, income, capital, or profits, even if Pretium was aware of the potential for such damages.
